2 Terms and conditions of use

The purpose of these General Terms and Conditions of Sale is to govern the contractual relationship between ITNC and,

the User, defined as a person having used one of the ITNC websites,
the Customer, defined as a person who has placed an order on the ITNC website and who has accepted these terms and conditions.

Consequently, all orders placed imply full acceptance of these General Terms and Conditions of Sale. Any other condition is binding on ITNC only after written confirmation from ITNC. The General Terms and Conditions of Sale may be modified at any time and without prior notice by ITNC, the modifications being applicable to all subsequent orders. The General Terms and Conditions of Sale are those in force on the day of the order.

Conditions of access and use of the site

The ITNC rolser-trolley.com website is accessible free of charge to any User with Internet access. All costs associated with access to the ITNC site are the responsibility of the User. The User remains solely responsible for his/her computer equipment and Internet access.

The Customer accesses his account after having identified himself with his User ID and Password. The Customer is obliged to keep his/her User ID and Password secret and must never communicate them to a third party.

ITNC makes every effort to ensure 24/7 access to the site. The company cannot be held responsible for any problem or malfunction of the site that would prevent access. ITNC will do its utmost to solve any problem as soon as possible.

Account creation

The User may create an account on the site to benefit from the following services:

place an order

create and modify a list of favorite items

be kept informed of upcoming promotions and new product announcements

use a promotional code before finalizing the shopping cart

submit a review of an item ordered

By creating an account, the User accepts ITNC’s General Terms of Sale and Privacy Policy.

Identified Users can unsubscribe from the newsletter at any time by clicking on the appropriate link at the bottom of each newsletter.

All mandatory fields on the account creation form must be filled in, otherwise the account cannot be created. All information provided by the User must be accurate.

As soon as account creation is complete, the User immediately receives an account creation confirmation e-mail. ITNC reserves the right to delete any account that does not comply with these Terms and Conditions.

3 General terms and conditions of sale

Orders

Customers may place orders directly on the rolser-trolley.com website.

The ordering process is as follows:

selection of items and addition to basket

validation of the basket

identification on the rolser-trolley.com website

choice of payment method

registration and confirmation of payment

From this moment, the order is recorded, and an order number is communicated to the Customer, as well as confirmation on screen and by e-mail. The data recorded by ITNC constitutes proof of the nature, content and date of the order.

Any order implies acceptance of the prices and description of the items available for sale.

ITNC reserves ownership of the items until full payment has been received for the order.

ITNC reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk.

ITNC undertakes to deliver orders received only within the limits of available stocks. In the event of unavailability of one or more items ordered, ITNC will inform the Customer as soon as possible and, if necessary, reimburse the Customer within 30 days of payment. The Customer’s order will then be automatically cancelled.

Items offered for sale on the rolser-trolley.com website and bearing the stock status “On pre-order” will be delivered as soon as they are restocked. The average delivery time for out-of-stock and pre-order items is approximately 2 weeks.

The customer is informed of the stock status “On pre-order” before the order on the product sheet and after the order on the invoice.

No unilateral cancellation of an order will be accepted without the agreement of ITNC.

Item prices

The prices shown on the ITNC rolser-trolley.com website are in Euros and include all taxes, but exclude shipping costs. Prices are subject to change without notice.

Prices are payable in cash on the day the order is placed. Prices are those applicable at the time of order, subject to availability and to typographical error or change in the French VAT rate (or change in the company’s status). Any change in this rate will be immediately reflected in the sales price.

Outside the European Union or French overseas departments and territories, and depending on the legislation in force in the delivery zone, customs duties and taxes may be charged to the customer by the customs authorities.

Item description

The items sold on the site are described, presented and photographed with the utmost accuracy. If, despite all our precautions, an error should occur, ITNC cannot be held responsible. ITNC may update, improve or withdraw items from sale without notice.

Shipping and delivery

Shipping time may vary depending on the item, but generally does not exceed 14 working days, except for items manufactured on demand via the configurator or items with the stock status “On pre-order”. In this case, ITNC will inform the customer of the manufacturing lead time.
If an item is temporarily out of stock, it is automatically shipped as soon as it is restocked. ITNC cannot be held responsible for stock variations and availability.

Delivery is made to the address specified by the Customer when placing the order.

Packages are delivered by DPD Group, Mondial Relay, Relais Colis, Chronopost, Colissimo or GLS. The choice of carrier is made by ITNC according to the weight and size of the parcel, and the destination.

In the event of force majeure or exceptional events (natural disasters, pandemics, epidemics, strikes, lock-outs, etc.) delaying or prohibiting the delivery of goods, ITNC is released from all liability.

In accordance with current legislation, goods travel at the consignee’s risk, even if shipped carriage paid. The Customer is obliged to check the conformity and good condition of the goods at the time of delivery and to make any reservations to the carrier.

Any claim relating to a defect in the goods delivered, to an inaccuracy in the quantities or to an erroneous reference in relation to the order confirmed by ITNC, must be made in writing within 3 days of receipt of the goods, failing which the right to claim will cease to exist.

Payment

ITNC offers 5 methods of payment according to customer profile:

Credit card

Customers can pay for their orders by credit card (Carte Bleue, Visa, Mastercard, Eurocard). Thanks to our banking partner, the customer can securely transmit the credit card number, the validity date and the last three digits on the back of the card. No banking information is stored by ITNC. Payment is made at the time of shipment or production of the item ordered.

Paypal

Customers can pay by Paypal either by logging in to their Paypal account, or as a Paypal guest.

Money order

This method of payment is exclusively reserved for French administrations. The customer must also send his stamped and signed order form by e-mail, fax or post. ITNC will process the order upon receipt.

Any order for which payment is not received by ITNC within ten working days will be cancelled.

Check

This method of payment is exclusively reserved for professionals, after agreement with ITNC.

Bank transfer

This method of payment is exclusively reserved for professionals, after agreement from ITNC.

Fraud prevention

ITNC reserves the right to verify the personal data communicated by the Customer and to adopt all measures deemed necessary to verify that the person whose bank account is used is indeed the one who placed the order, in order to avoid any fraudulent payment. This verification may take the form of a request for proof of identity and/or address and/or bank documents (RIB or cancelled cheque). If there is no response from the Customer within 2 days, the order is cancelled by ITNC, without any possibility of subsequent claim.

ITNC is also free to cancel any order that presents one or more fraudulent risk factors.

Return for exchange or refund

The customer has a period of 14 days from the date of receipt to exchange or request reimbursement of an item, without having to provide any justification or pay any penalties.

Return shipping costs are at the customer’s expense. Returned items must be new, unused and in their original packaging. All returns require the prior agreement of ITNC. In the absence of agreement, any returned item is held at the Customer’s disposal at the Customer’s expense, risk and peril, all transport, storage and handling costs being at the Customer’s expense. Items are returned at the Customer’s expense and risk.

The return address will be communicated to the customer in the e-mail containing the return number.

In the event of an exchange, if the value of the exchanged items is less than the original order, ITNC will refund the difference. If the amount of the exchanged items is higher than the initial order, the Customer will pay the difference to ITNC.

When will I be reimbursed?

In the event of a product return

We will reimburse you approximately two weeks after receipt of your return package at our warehouse (except weekends and public holidays). All refunds are made to the name of the customer who placed the order and to the billing address.
For credit card refunds, please note that interbank delays may delay the actual credit to your account by a few days.

In the event of order cancellation

We will refund within two working days of your request. The request must be sent via the contact form.

How long does a refund take?

For credit card payments:

Once the refund has been issued by our services, it may take between three and eight working days for it to appear on your bank statement, depending on your bank’s processing times.

If payment was made by credit card, the refund can only be made to the card used for the original purchase. It is not possible to obtain a refund directly on another card.

If the card used for the purchase is no longer valid and a replacement card has been issued, the refund should automatically appear on your new card. If no replacement card has been issued, contact your credit card issuer to find out how to proceed.

For PayPal orders:

PayPal refunds can also take between three and 7 working days, or sometimes longer if the refund is issued by PayPal e-check.

If you have paid by credit card without logging in to a PayPal account, i.e. using PayPal’s guest payment system, the purchase will be refunded to your credit or debit card. You may have to wait up to 30 days for the refund to appear on your statement.

Transaction security

ITNC assures its Clients that it will do everything in its power to ensure the confidentiality and security of data transmitted on the Web and on the website. The website uses a secure SSL (Secure Socket Layer) payment module.

Warranty

Depending on the item and the date of purchase, repairs are carried out either by ITNC or directly by the manufacturer. It is the Customer’s responsibility to keep all packaging and accessories supplied with the item, as well as any labels affixed to the item or its packaging, which are necessary to benefit from the warranty offered.

The warranty does not cover damage resulting from accidents, misuse or negligence. In the event of the return of non-defective equipment, the customer may be billed for shipping, handling and testing costs.

ITNC will apply the warranty to any item returned as soon as possible. However, when repairs require the item to be returned to the manufacturer, the company cannot be held responsible for any delays caused by the manufacturer.

Garantie Sérénité

The Sérénité warranty provides for the replacement of parts found to be defective or broken. Wear parts are not covered by this warranty.

Only Andersen brand carts and components: chassis, fasteners, handle, wheels, base, nets are covered by the Garantie Sérénité.

ITNC reserves the right to refuse to replace a component or to propose an alternative.

Liability

ITNC is not the manufacturer of the items presented, within the meaning of French law no. 98-389 of May 19, 1998 concerning liability for defective items. Consequently, in the event of damage caused to a person or property by a defect in the item, only the manufacturer’s liability may be sought by the Customer.

ITNC’s liability for any loss suffered by the Customer is expressly limited to the price of the defective items received by the Customer.

Retention of title and liability

ITNC retains ownership of the items sold until full payment has been received from the Customer. The transfer of ownership of the items to the Customer occurs upon full payment of the price. However, during the period between delivery and transfer of ownership, the risks of loss, theft or destruction are borne by the Customer.

Failure by the Customer to meet its payment obligations, for any reason whatsoever, gives ITNC the right to demand the immediate return of the items delivered at the Customer’s expense, risk and peril.

Data confidentiality

All information provided by the Customer when visiting the ITNC website is strictly confidential and used exclusively by ITNC.

Its purpose is to :

to complete the purchase, from order to delivery
to improve ITNC’s services in order to better satisfy the Customer. In accordance with the French Data Protection Act, the Customer has the right to access, rectify and withdraw his/her personal data.

Under no circumstances will the Customer’s contact details be transferred, sold or rented other than to carry out a delivery or to respond to an injunction from the legal authorities.

Intellectual property rights

All texts, comments, images, photos, etc. presented on the ITNC site are reserved under copyright and intellectual property law (France and international). As such, and in accordance with the intellectual property code, use for private purposes, subject to different or even more restrictive provisions of the intellectual property code, is only tolerated by ITNC. Any total or partial reproduction of the ITNC site is strictly forbidden without prior agreement.

Attribution of jurisdiction

Relations between ITNC and the Customer are governed exclusively by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Any legal action will be brought before the competent courts.

The contractual information is presented in French and the items offered for sale comply with French regulations. Where applicable, it is the foreign customer’s responsibility to check with local authorities regarding the use of the item he/she intends to order. ITNC shall not be held liable in the event of non-compliance with the regulations of a foreign country.

The place of performance of the contract is contractually fixed at the head office of ITNC. The place of jurisdiction is Bourg-en-Bresse. The Customer’s General Terms and Conditions of Purchase, if any, cannot be set up against the present General Terms and Conditions of Sale.
